These general terms and conditions of sale govern all relations between the-sages.com and the users of the site.

These general terms and conditions also apply to all sales on the-sages.com website. 

The website the-sages.com sells the following products on its online store: Clothing, jewelry and fashion accessories. 

The-sages.com is not only an online store but also a journalistic information site for non-customers of the online store. The non-profit information site includes an online magazine. The video interviews broadcast on our YouTube channel and the press articles are the exclusive property of The-sages and may not be reproduced in part or in full by third parties. However, they may be distributed by third parties (bloggers, influencers, individuals, newspapers) without alteration or transformation of the content in compliance with the legislation on freedom of expression and intellectual property, which includes respect for the-sages.com brand and the interviewees. 

The-sages.com also includes a page dedicated to the computer search of hundreds of brands present in the ethical fashion sector and whose collections are notably designed from recycled materials and plants. The Veryfair search engine has been designed to allow visitors to find ethical brands that correspond to their values. The promotional page of a brand redirects the visitor to its website and social networks. 

The brands presented do not pay any royalties or sell their products on the-sages.com online store. The Veryfair search engine is not responsible for the information of the brands, as Veryfair lists information already present on the website of the brands, information accessible from their sites by third parties, press and individuals. If a brand wishes to update or complete the information collected, or no longer wishes to appear on the search engine, it may request the modification or removal of its profile at the following email address: contact@the-sages.com.

The user of the-sages.com declares that he/she is of legal age and capacity to visit the site and make purchases. 

The customer declares to have read and accepted the general conditions of sale prior to placing the order. The confirmation of the order is therefore acceptance of the general conditions of sale.

Article 1 - Principles

General terms and conditions:

• express the entirety of the obligations of the parties. In this sense, the buyer is deemed to accept them without reservation
• have superior force to any other version or any other contradictory document
• may be modified from time to time and will be applicable as soon as they are put online.

If a condition of sale were to be lacking, it would be considered to be governed by the practices in force in the remote sales sector whose companies have their headquarters in France.

Article 2 - Pre-contractual information

The buyer acknowledges having been informed, prior to the placing of the order and the conclusion of the contract, in a legible and comprehensible manner, of the present general conditions of sale and of all the information listed in article L.221-5 of the Consumer Code.

In particular, the following information shall be provided to the buyer in a clear and comprehensible manner:

• the essential characteristics of the property;
• the price of the good and/or the way the price is calculated;
• additional shipping and delivery costs;

Article 3 - The order

Any order implies acceptance of the prices and the description of the products available for sale.

The order will be definitively validated only upon receipt of the summary mail sent to the User and only after final payment.

The-sages.com reserves the right to refuse the User's order for legitimate reasons related to trust, non-payment or doubt about the possibility of delivery to a given location. 

The-sages.com may also refuse to accept an order if it is to be delivered to a dangerous or confined geographical area, if the delivery costs are too high, or if it is to be delivered to a country or territory that is on the list of territories subject to global sanctions programs or under international vigilance.

The-sages.com may ask the User for additional information, and may refuse the order if the information collected seems insufficient.

Article 4 - Availability

The products and price offers are valid as long as they are visible on the Site, within the limits of available stocks. The buyer will be informed of any unavailability of the product or good ordered. 

The date of availability appearing in the description of the products on the Site is given as an estimate.

The promotional offers are valid as long as they are visible on the Site and within the limits of available stocks.

In the case of pre-ordering a product, the delivery time is given for guidance only and is not binding on the-sages.com. This delivery time may be modified, either upwards or downwards, depending on the circumstances, in particular those relating to manufacturing, transport conditions, suppliers' possibilities or any other events that may modify the manufacturing conditions.

Article 5 - Electronic signature

The online provision of the buyer's credit card number and the final validation of the order with acceptance of the payment will be considered as proof of the buyer's agreement, the payability of the sums due under the purchase order, signature and express acceptance of all operations carried out.

Article 6 - Product information

The products governed by the present general conditions are those which appear on the seller's website and which are indicated as sold and shipped by the seller. They are offered within the limits of available stocks.

The products are described and presented with the greatest possible accuracy. However, if errors or omissions could occur as for this presentation, the responsibility of the salesman could not be committed.

The photographs of the products are not contractual. 

Article 7 - Prices

The seller reserves the right to modify its prices at any time but commits to apply the prices in force at the time of the order, subject to availability at this date.

The prices are indicated in euros. They do not take into account the delivery costs, billed in addition, and indicated before the validation of the order. The prices take into account the VAT applicable on the day of the order and any change in the applicable VAT rate will automatically be reflected in the price of the products in the online store. The price will be payable in full at once. A summary invoice of the order will be available upon shipment of the order on the "My Orders" section of the customer account.

Prices may be displayed for guidance in another legal currency, in which case the exchange will take place under the conditions of the receiving organization. All orders are payable in Euros, regardless of the country of origin of the order. The-sages.com may be obliged to refuse an order if the price of the order results from a technical or human error, or from an external intervention. If one or several taxes or contributions, in particular environmental, were to be created or modified, in rise or in fall, this change could be reflected on the selling price of the products.

Article 8 - Customs duties

When the delivery is made outside of France, the User is considered as the importer of the products concerned.

For all products shipped outside the European Union, customs duties or other local taxes or import duties or state taxes may be due on the exported product(s).

These taxes, duties and sums are not the responsibility of the-sages.com but exclusively the responsibility of the customer, importer of the products.

The User will in this case be responsible for their payment and any related declarations.

If the User refuses to pay the fees and/or make the declarations, the product(s) will be returned to the-sages.com and the User will not be able to make any claim for refund.

Article 9 - Method of payment

It is an order with obligation of payment, which means that the placing of the order implies a payment of the buyer.

The payment of the price is carried out in totality with the day of the order, according to the following methods:

• credit card ;
• paypal ;
• Alipay (pour la chine) ;
• WeChat Pay (pour la chine).

For shipments in France, the invoices will be downloadable on the Site on the customer account.

For international shipments, the invoice will be attached to the shipment to ensure compliance with customs requirements.

Article 10 - Order processing time

The-sages.com processes orders from Monday to Friday (except on public holidays), within an average of 48 to 72 hours. At certain times, the processing time may be longer due to the greater number of orders to be processed. Except in case of force majeure or during periods when the online store is closed, shipping times will be, within the limits of available stocks, those indicated above.

Article 11 - Delivery times and terms

The maximum delivery time, including transport, is 30 working days from the confirmation date of the order, unless otherwise expressly stipulated before the order is placed and prior to its final confirmation.

In all cases, the customer will automatically receive an email informing him/her of the shipment and tracking of his/her order. Each delivery will be deemed to have been made as soon as the product has been made available to the customer, by the postal service or by the carrier.

In France, Colissimo products are delivered on average within 48 working hours. In Europe, allow 3 to 4 days for most countries such as Germany, Italy and Ireland. With Chronopost express in France, you can benefit from next-day delivery before 10 a.m. or 1 p.m.1, and in 2 to 5 days for international deliveries. Elsewhere in the world, allow 5 to 9 days for delivery.

The parcels are delivered with a signature. For deliveries to collection points, the customer must bring his ID and the order form. He has 10 working days since the arrival of the package at the post office or collection point to collect it. After this period, it will be returned to the sender and no refund will be made.

The products are delivered to the delivery address indicated by the User during the ordering process. The delivery time indicated on the site is the time generally observed at the departure of the warehouses. It is expressed in working days. However, these times may be extended in cases of force majeure, strikes, and depending on the health or social situation. We remind you that the shipping times run from the reception of the shipping email, that is to say when the package has been handed over to the carrier. The goods are considered shipped when the carrier collects the goods.

Article 12 - Delivery rates

In particular, the purchases made on the Site are increased by a fee for transport which will appear before the validation of the order and will be included on the invoice.

Acceptance of the order implies acceptance of the amount of this fee and any additional costs.

Article 13 - Delivery errors

The buyer shall file with the seller on the day of delivery or at the latest on the first business day following delivery, any claim of error of delivery and/or non-conformity of the products in kind or in quality compared to the indications on the order form. Any claim made after this deadline will be rejected. The claim can be made by email to the following address: contact@the-sages.com.

Any complaint not carried out in the rules defined above and within the time limits could not be taken into account and will release the salesman from any responsibility towards the purchaser.

Article 14 - Refunds and returns

International and French returns are at the customer's expense. Customs fees may apply, they are also charged to the customer.

Refund of shipping costs : The-sages.com will reimburse the shipping costs incurred by the customer if the latter has made a request for return to the-sages.com customer service and the order is returned to LOGITRAB, 7 Boulevard Maritime, 13500 MARTIGUES, FRANCE in its entirety within 45 days of receipt of the order. Condition of the products : All returned products (shoes, clothing, luggage, accessories, labels, etc.) must not have been worn, washed or damaged, and must be returned intact in their original packaging (tissue paper, plastic bag, original labeling). Upon receipt of the package, the-sages.com will judge the condition of the returned goods. No returns will be accepted and therefore no refunds will be made if the returned products have been visibly used or damaged by the customer and if this use or damage makes the product unfit for sale.

Refund of returns : In the case of returns that comply with the above conditions, the-sages.com will refund the returned goods within 20 days of the goods being returned. The refund will be made by the same method of payment used for the customer's order.

Article 15 - Responsibility

The Sages Veryfair is only responsible for the access to the website and the ordering process. The Sages Veryfair shall not be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, an external intrusion or the presence of computer viruses, or for any event qualified as force majeure, in accordance with case law.

In accordance with the regulations in force, the-sages.com shall not be liable in the event of non-fulfilment of the order attributable to the User, to the malfunctioning of a payment system or a computer breakdown, to the unforeseeable and insurmountable act of a third party, or to an act of force majeure.

The Sages Veryfair shall not be held responsible if the order is not completed or if it is prevented from fulfilling any of its obligations due to a case of force majeure as defined by jurisprudence, in particular in case of strike or bad weather preventing the delivery of the order.

For the products having been the subject of a personalization, the company The Sages Veryfair could not be held responsible for the choices of personalization of the personalized article which would not be appropriate, and in particular of the possible difference of color "screen/reality".

The User is required to check the conformity of the products offered by the Site with the laws governing the country where these products will be used. The Sages Veryfair shall not be responsible for any infringement that the User may commit by purchasing, using or holding the said products.

The photographs on the Site are purely illustrative and are not contractually binding.

Article 16 - Right of withdrawal

Application of the right of withdrawal

In accordance with the Law No. 2014-344 on consumption of March 17, 2014, the User has the right to notify The Sages Veryfair that he/she renounces the purchase within fourteen days from the day after the day of delivery of the product if he/she resides in France, thirty days if he/she resides in another country. Used, damaged or incomplete products will not be accepted.
We remind you that damaged, soiled or incomplete products are not accepted. The product(s) must be returned in new condition (unworn, undamaged or dirty) and must not have been used for a long period of time (beyond the time necessary for testing). They must be returned in their original packaging, accompanied by any accessories.
In case of exercising the right of withdrawal within the above-mentioned period, the price of the product(s) purchased will be refunded within 20 working days.
However, the direct costs of returning the product(s), in their original packaging, are the responsibility of the User.The refund will be made using the same payment method as the one used by the User for the initial transaction. This refund will not incur any costs for the User.

In accordance with the provisions of Article L221-28 paragraph 13 of the Consumer Code, the User may no longer exercise his right of withdrawal once he has agreed to access the reading of a product in digital format, the right of withdrawal cannot be exercised for books and digital media.

Article 17 - Intellectual property

The content of the website remains the property of the seller, the only holder of the intellectual property rights on this content.

The buyers commit themselves not to make any use of this content; any total or partial reproduction of this content is strictly forbidden and is likely to constitute an offence of counterfeiting.

Article 18 - Partial non-validation

If one or more stipulations of the present general conditions are held to be invalid or declared as such in application of a law, a regulation or following a definitive decision of a competent jurisdiction, the other stipulations will keep all their force and their scope.

Article 19 - Language of the contract

The present general conditions of sale are written in French, English and Chinese. Only the French text is authentic in case of dispute.

In accordance with Article 14 of Regulation (EU) No. 524/2013, the European Commission has set up an Online Dispute Resolution platform, facilitating the independent out-of-court settlement of online disputes between consumers and professionals in the European Union.

The computerized records, kept in the computer systems of the company The Sages Veryfair and its partners in reasonable conditions of security, will be considered as proof of communications, orders and payments between the parties.

Article 21 - Applicable law

The present general conditions are subject to the application of French law. The competent court is the judicial court of NANTERRE.

It is so for the rules of substance as for the rules of form. In case of dispute or claim, the purchaser will address in priority to the salesman to obtain a friendly solution.

The personal data provided by the buyer are necessary for the processing of his order and the establishment of invoices.

The buyer has a permanent right of access, modification, rectification and opposition with regard to the information concerning him/her in accordance with the RGPD. This right can be exercised under the conditions and according to the methods defined on the-sages.com.

The personal data that are collected on this site are the following:

 - account opening: at the time of the creation of the account of the user, his name, first name, e-mail address, telephone number, postal address.
